Terms and Conditions

1. Acceptance of Terms
By accessing or using the Tamaat GIS platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
Tamaat GIS provides a cloud-based Geographic Information System (GIS) for mapping, spatial analysis, and data visualization. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
3. User Accounts
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Educational and Student Use
Educational institutions may use Tamaat GIS under standard commercial plans or separate institutional agreements. Academic verification may be required for institution-specific onboarding or procurement workflows.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Tamaat GIS and its licensors. The Service is protected by copyright, trademark, and other laws.
6. User Content
You retain ownership of any data, maps, or other content you upload to the Service ("User Content"). By uploading User Content, you grant Tamaat GIS a license to use, store, and display your User Content solely as necessary to provide the Service to you.
7. Subscriptions, Billing and Payments
Paid plans are billed in advance on a monthly or annual basis. Annual plans are offered at a discount to the equivalent monthly price. Prices may be presented and charged in your local currency where supported.
Payments are processed by Paddle.com, which acts as the Merchant of Record for all purchases. Paddle is the seller of record and is responsible for collecting and remitting applicable sales tax, VAT and GST. Your payment card details are held by Paddle and are never stored by Tamaat. Saved payment methods, invoices and cancellation can be managed through Paddle’s customer portal, and Paddle retains transaction records in accordance with its own legal and tax obligations.
Refunds are granted at our discretion and are requested through support. An approved refund ends the subscription immediately. If a payment fails, we may retry it for a limited grace period during which access continues; if it remains unpaid, the account is locked as described below.
8. Cancellation, Data Retention and Deletion
You may cancel at any time. Your plan remains active until the end of the billing period you have already paid for, and you will not be charged again. Cancelling does not entitle you to a refund of the unused portion unless a refund is separately approved.
When a subscription ends — by cancellation or expiry — or when a trial lapses, the account is locked and the workspace can no longer be used. Your User Content is then retained for 30 days. During that window you may export your data or resubscribe, and resubscribing restores your workspace. We will send reminders before the window closes.
After 30 days, User Content is permanently deleted and cannot be recovered. Billing and invoice records are retained separately for as long as required by applicable tax and accounting law, and payment data is held by Paddle under its own retention policies. You may request earlier deletion of your account by contacting us.
9. Third-Party Satellite and Earth Observation Data
Remote sensing features (including area monitoring, change detection, and imagery search) are provided by default using Earth observation data that third parties make openly available — principally the European Space Agency’s Copernicus Sentinel programme, together with openly published products and catalogues operated by agencies and hosting providers such as NASA, the USGS, and cloud open-data programmes.
We do not own, operate, or control these satellites, catalogues, or hosting services, and we do not charge you for the underlying data. Their availability, coverage, revisit frequency, licensing terms, processing methods, and continued existence are determined solely by those third parties and may change, degrade, be rate-limited, or cease entirely without notice to us or to you. Observations may also be unavailable for reasons inherent to the technology, including cloud cover, seasonal darkness at high latitudes, and satellite maintenance. We therefore do not warrant the continuous availability, completeness, accuracy, or fitness for any particular purpose of third-party Earth observation data, and we are not liable for any loss arising from its unavailability or change.
Bring your own data. Where a business, regulatory, or contractual process depends on continuity of imagery, you should not rely solely on openly available sources. The Service supports supplying your own imagery — including commercially licensed satellite data, aerial or drone capture, and imagery you already hold — for use with the same analysis, monitoring, and evidence features. You are responsible for holding the necessary rights and licences to any data you supply, and for ensuring your use complies with the terms attached to it. We recommend that customers with continuity-critical obligations arrange such a source in advance.
Outputs of remote sensing analysis are derived measurements and indicators, not verified statements of fact about conditions on the ground. They require review and interpretation by a suitably qualified person before being relied upon for any regulatory, contractual, legal, financial, or safety-related decision.
10. Limitation of Liability
In no event shall Tamaat GIS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
12. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
